The Italian Decree

The Italian Decree has been released, and is available here. (Google translate)

The most interesting thing here seems to be that they seem to state that it can’t be ruled out the The Pirate Bay is not in Italian jurisdiction, at least partially. This must be a first! They’re not proving, they’re simply “not ruling out”, and that’s basis for why the site must be blocked. They also state that TPB is run by four people – I guess they’re listening to Ifpi all over again – when in fact, some of the people claimed to run the site do not. Guilt by association, again and again, over and over.

More, to show that TPB is a commercial entity is the policy on the site stating that you can be charged with a fine if you use the system for commercial reasons without prior consent. I don’t get it – how do that make it a commercial entity? It’s simply not wanted to use the site for spam, and that’s it.

Further, they also claim that TPB must be illegal since it’s using the name Pirate. It’s so stupid, this is something Ifpi has tried all over the world. We reclaimed the word Pirate. We see Pirates as someone who goes outside the main sphere, it has nothing to do with anything illegal. Ifpi has btw stopped using piracy as a swear word – they realised it was won over by the hearts of the pirates and that it was a glamourus thing to be a pirate.

But the MOST interesting thing is that domain I’ve never seen – angloamericanletting.com – owned by someone in the UK. It must probably just resolve to the same IP that TPB has (maybe a coincidence or maybe he’s just a fan). Sorry, but he’s now got an illegal domainname in Italy. I hope more people will point their domain names to TPB and let their friends have the links, let’s try and make like 10.000 domains illegal and listed in the filters of Italy. My sources say it’s about 4.000 domainnames in the filter today, wouldn’t it be awesome if it would more than double up just for the bay?

Censorship is becoming a huge problem around the world, i can’t believe it took me so long to see it, i just hope all the people who haven’t do so quickly and try and do something about it. We have a voice, use it.

I’m Italian and not a lawyer. The decree is full of technical mistakes and very inaccurate even in simple matters (e.g. they say you must be a logged user to download any torrent). It’s based of course on a technical relation, but the Italian “GIP” of course doesn’t understand a word of what he copies :-) . In the non technical parts it’s written in an absurd extrafunny italian language (I translate: “the site is strictly and ontologically functional to…”, “ontologically” yeah, is this Heidegger or just another poor Italian wanna be writer/philosopher speaking?).
To be honest the GIP says TPB is commercial because of the banners and the policy. Thee decree puts heavy emphasis on the banners’ revenues. (I know nothing of these banners, cause I use firefox+noscript, sorry :-( )
On the basis of this decree they could shut down even Mininova (even trackerless sites), or better they could shut down any site they want, just claiming “it violates copyright”. The most important Italian newspaper (not owned by Mr. Berlusconi) “La Repubblica” has written about this danger for democracy.
I’m very sorry you will be probably charged with “associazione per delinquere” (I don’t know if it’s exactly translated by “guilt by association”, I would be wrong but maybe it’s something worst…).
Thanks for your work, brokep. And be sure many Italians are very concerned by what’s happening (and all this happens in a country where most people still use Emule; life is lame yeah)

What’s clear by reading the decree is that the hijacking to pro-music IP wasn’t asked by the GIP. At this point it’s unclear if it was asked by the Guardia di Finanza or decided by the ISPs.
We’ll see…

Hi Peter.

I did wrote somethin’ about this sh*t. Im livin’ in Turkey and we are just okay about this stuff. We also have banned global sites like Youtube, Dailymotion, Alibaba, Slide.com etc etc.

A quote from my entry;

“Note for Peter; That bullsh*t is not new in here my friend. Because TPB is already banned in Turkey, and we can just openin’ via proxies. I hope you will fix this shit.”

Its bad for everybody. Coz im users of TPB.

I’m a technical translator and software localizer. Like most Italians during these days, I’m following the event of the banning or your ips by the italian government. Censorship is an indicator of society’s weakness. Consumerism, bourgeoisie and (organized) criminal capital are trying to impose their short sided interests upon the world. The whole idea behind the internet itself is in the free flow of information. I suppose it’s fairly difficult for someone with 19-th century-Yankee frame of mind to understand and accept this.
